ai / text and data mining -reservation of rights notice
moksha recordings ltd, moksha management ltd, tairona songs ltd, amokshasong and their associated companies and rightsholders expressly reserve, to the fullest extent permitted by law, all rights in copyright works, sound recordings, musical compositions, lyrics, performances, audiovisual works, artwork, photographs, metadata and other content owned, controlled or administered by them (‘moksha content’).
except where expressly authorised by prior written agreement with the relevant rightsholder, moksha content may not be used for:
- training, developing, fine-tuning, testing or evaluating artificial intelligence or machine-learning models or systems;
- text and data mining;
- creation or augmentation of training datasets;
- extraction or creation of embeddings, features or other machine-readable representations for ai or machine-learning purposes;
- generative artificial intelligence systems;
- voice, likeness or performance cloning or simulation;
- generation of synthetic sound recordings, musical compositions, lyrics, performances or audiovisual content; or
- any substantially similar computational use.
for the avoidance of doubt, all applicable rights are expressly reserved for the purposes of article 4(3) of directive (eu) 2019/790 on copyright and related rights in the digital single market, and under all other applicable copyright, related-rights and intellectual-property laws.
the making available of moksha content online, including through websites, streaming services, social-media platforms, digital service providers or other digital services, does not constitute consent to its use for artificial-intelligence training, machine learning, text and data mining or generative-ai purposes. no licence, consent or authorisation for such use should be inferred from public availability of the content.
this reservation applies only to rights owned, controlled or administered by the relevant moksha entity or rightsholder. certain recordings, compositions and other materials associated with artists represented by moksha may be owned, controlled or administered by third parties. nothing in this notice purports to reserve rights on behalf of a third party where moksha does not have authority to do so.
any person or organisation seeking permission to use moksha content for artificial-intelligence, machine-learning or text-and-data-mining purposes must obtain prior written authorisation from the relevant rightsholder.
